Revealed: Landlord prices for tribunal hearings

The government has introduced a new fee framework for property-related cases at the First-tier Tribunal. How much will landlords and tenants have to pay?

The government expects tribunal cases to rise thanks to the Renters’ Rights Act. The Renters’ Rights Act gave local authorities more powers to charge landlords civil penalties, for example if a landlord tries to end a tenancy verbally instead of using the required form.

Challenging one of these new penalties will cost a landlord £200 for the application and another £300 for the hearing, or £500 in total.  

Challenging a rent repayment order is a bit cheaper: £114 for the application fee and £227 for the hearing.

Tenants will also have to pay tribunal fees when they try to get existing rents reduced within the first six months of the tenancy, or when they challenge a rent increase. However, the fee for this is lower at £47. Fees may also be reduced if they are on a low income, have few savings, or claim certain benefits.

They can also help landlords avoid penalties in the first place by assisting with compliance around the Renters’ Rights Act. And when tenants challenge rents in court, agency data can help demonstrate that the rental amount is in line with the local market.

More cases mean more risk, and more need for strong compliance and documentation processes.
